FAQ

Mediation is a structured dispute resolution process through which disputing parties work with a mutually selected neutral third party, the Mediator, to help facilitate a jointly acceptable resolution of their dispute. Mediation is confidential, cost-efficient, and collaborative.

MCDR provides dispute resolution services in the areas of (i) matrimonial and family law; (ii) estate, elder, and inheritance law; (iii) labor and employment law; (iv) business and commercial law; and (v) non-profit board, mosque, and community organization disputes.

Mediation can be utilized at any stage of the dispute, whether the dispute is just arising [pre-suit], or has already been filed in court, or is pending in arbitration [post-filing]. A party may complete and submit MCDR’s Case Initiation Form to begin the mediation process and provide a copy of the parties’ agreement, which will specify the use of mediation. If mediation is not contractually obligated, a party may still submit to mediation by inviting the other party to the mediation. A party may appear pro se or with an attorney or representative.  MCDR prioritizes confidentiality, and each individual participating in Mediation must sign and abide by MCDR’s Confidentiality Agreement.

MCDR employs the highest standards of integrity and transparency in its work, and quality mediators are at the heart of MCDR’s work. Parties select a Mediator from MCDR’s National Roster of Mediators. MCDR offers a diverse roster of trained mediators in local jurisdictions across the United States in which disputing parties can have the utmost confidence. Each MCDR Mediator undergoes an application process, and a rigorous orientation, and commits to abide by the Model Standards of Conduct for Mediators and take necessary continuing legal education and mediation training required by their State of admission to the Bar.

MCDR charges a one-time case initiation fee of $150.00.  Unless agreed otherwise by the parties, each party equally splits the Mediator’s fees, which are outlined on the Mediator’s profile on MCDR’s website.

MCDR provides mediation across the United States, in-person and remotely utilizing an online video conferencing platform such as Zoom or Microsoft Teams.
